First, the arbitrator listens to both parties and formulates his judgmentwhich is kept away from the parties. In the second stage, mediation occurs whereby if they don’tarrive at a common ground, they proceed to the third stage. In the third stage, both parties inquestion are expected to respect the arbitrator’s final judgment. In voluntary arbitration, theparties are not obligated to abide by the arbitrator’s final determination.In contrast, in permanent arbitration, the parties are expected to observe the arbitrator’sfinal rule, whether by law or pact An arbitrator may hear and rule on one case or handle severalissues in a total settlement package. The arbitration may either be deliberate or permanent(Lewicki et al., 2020, p. 564-566). The final decision is made considering the arbitrator’ssuggestion, especially when both parties disagree during mediation.The arbitration may lead to parties putting in less or no effort in the bargaining processafter realizing the arbitrator will divide the disagreement, referred to as the chilling effect. Thechilling effect can be solved by a final offer arbitration where the arbitrator must decide to pickout either party’s verdict as the final decision (Lewicki et al., 2020, p.566). The arbitration mayresult in further disagreement between the two parties since the arbitrator’s last decision may notbe considered by both parties. Therefore, the decision made may not be implemented. Making adecision and not implementing it would result in a loss of time and funds since the arbitrator ispaid to perform his duties and takes plenty of time to come up with an appropriate decision. Thenegotiators’ power to take charge of the results is taken away from them when a third party isbrought in. Most arbitrators take control of the whole decision-making process; therefore, thearbitrator overpowers both parties he makes most judgments. The final decision is arrived atconsidering the arbitrators’ recommendations.A situation in which it is difficult to make amends is referred to as an Impasse. Animpasse is due to the conflict created during bargaining with a negotiator (Lewicki et al., 2020,p.510-511). Impasses are created by disagreements between two parties, especially when theycannot arrive at a common conclusion due to their untimely differences.
